Using our Website

Please read these terms and conditions of use (“Terms of Use”) carefully.

You (“you”/ “your”) may use the British Chinese Heritage Centre (the “Site”) subject to these Terms of Use. Accessing and using the Site constitutes acceptance by you of the Terms of Use in force at the time of use. If you do not agree to all of these Terms of Use, do not use the Site.

The Site and British Chinese Workforce Heritage Project are provided to you by Ming-Ai (London) Institute (“we”/ “our”/ “us”), an initiative of the Ming-Ai Association, having it registered office at 1 Cline Road, London N11 2LX, registered under company number 02763177 and registered as a charity under number 1015621.

We reserve the right, at our sole discretion, to revise and update these Terms of Use at any time without further notice.  We will post the latest version of our Terms of Use on this page. We will post the last date of any change to these Terms of Use at the top of this page. Your continued use of the Site after such changes will mean you accept those changes.

Intellectual Property Rights & Copyright Notice

The content on the Site, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like, (“Content”) and the trademarks, logos and other intellectual property rights contained therein (“IP Rights”) are owned by Ming-Ai (London) Institute or licensed by third parties (“Licensor”) to Ming-Ai (London) Institute, subject to copyright and other intellectual property rights under English law. Ming-Ai (London) Institute and the Licensors retain all rights, including copyright, in the Content on the Site and the files related thereto.

Approved Use

Content on the Site is provided to you “as is” for your information and personal use only. Unauthorised commercial use or publication of Content contained in the Site is specifically prohibited. Content must not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for commercial use, publication or any other purposes whatsoever without the prior written consent of Ming-Ai (London) Institute. Written consent by Ming-Ai (London) Institute for such use is granted on a case by case basis at the sole discretion of Ming-Ai (London) Institute and Licensors. Ming-Ai (London) Institute reserves all rights not expressly granted in and to the Content.

As a condition of your use of the Site, you agree that you will not use it or any material or information on it for any purpose that is unlawful or prohibited by these Terms of Use.

You may not use the Site:

(a) for the purpose of harming or attempting to harm any third party in any way (in particular minors);

(b) to send, knowingly receive, upload, download, use or re-use any material which (i) is inaccurate, discriminatory, defamatory, obscene, threatening, deceptive, abusive, profane or offensive (or is likely to be perceived as such) (ii) promotes violence or any other illegal or immoral activity (iii) is in breach of anyone else’s intellectual property (iv) adversely affects the performance or availability of the Site; or (v) which is otherwise in breach of any of our Terms of Use;    

(c) to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of solicitation; or

(d) to knowingly transmit any viruses, worms, trojans, or any other contaminants that may be used to access and/or modify, delete or damage any data files or other computer programs.

You agree that you are using the Site for yourself and not for any commercial purposes and that you have the legal authority to use the Site in accordance with these Terms of Use.

Interactive Services

We may from time to time provide interactive services on the Site, including, without limitation, the ability to upload content, blogs or discussion forums (“Interactive Services”).

Any material (which may include photos, blogs, postings and comments) that you upload on to the Site via the Interactive Services or other publicly accessible forum or area of the Site, or for the purposes of general publication (“User Generated Content”) will be considered non-confidential and non-proprietary, and we will have the worldwide and sub-licensable right to use, copy, distribute disclose and make available to third parties any such material for any purpose connected with the Site. The posting on the Interactive Services or any other publicly accessible forums or areas of the Site of threatening, defamatory, pornographic, political or racist material or any material that is otherwise unlawful or harmful is expressly prohibited.

The Site is a venue for content supplied by third parties and visitors to the Site. Accordingly, we have no specific prior review process or editorial control over such content. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties are those of the respective parties and not necessarily ours. Neither we nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any third-party content, nor its merchantability or fitness for any particular purpose.

Linking Policy

You do not have to ask permission to link directly to pages hosted on the Site. However, we do not permit our pages to be loaded into frames on your site. Our pages must load into the user’s entire window.

We only link to British Chinese Workforce Heritage Project partners, and websites which provide useful information that supplements our own information services. We are not responsible for the contents, accuracy, opinions or links from these websites. We cannot accept any liability whatsoever and howsoever arising in relation to any such other sites (including, for the avoidance of doubt and not by way of limitation, any inability to access or delay in accessing any such other site) or in relation to any material or information appearing on them or which you may otherwise come across after leaving our site by way of a hypertext link or any other means.

Access to the Site

Access to the Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Site without notice. We may restrict access to some parts of the Site to users who have registered with us.  You must treat all passwords as confidential and must not disclose them to any third party.  We have the right to disable any user identification code or password at any time if in our opinion you have failed to comply with any of the provisions of these Terms of Use.

It is your responsibility to ensure your computer or mobile device meets all the necessary technical specifications to enable you to access and use the Site. The Site is only licensed for use on a device owned or controlled by you.

We may, from time to time, restrict access to certain features, content, or all or part of the Site.

We cannot guarantee the continuous, uninterrupted or error-free operability of the Site.  There may be times when all of, or certain features, parts or content of, the Site become unavailable (whether on a scheduled or unscheduled basis) or are modified, suspended or withdrawn by us, in our sole discretion, without notice to you.  You agree that we will not be liable to you or to any third party for any unavailability, modification, suspension or withdrawal of the Site, or any features, parts or content of the Site.


You acknowledge that you use the Site at your own risk and that we shall not be liable for any loss (whether direct, indirect, incidental or consequential damages) resulting from your use of the website and the material.
All material is provided on an “AS IS” basis. We cannot warrant that the Site or any material provided will meet any of your needs or requirements or that it will be complete, error free, accurate or that it will be delivered without interruption, fault or error. Accordingly and to the maximum extent permitted by applicable law, we hereby disclaim all warranties, conditions, whether expressed, implied or statutory, regarding the website and the material, including, but not limited to, any warranty of satisfactory quality or fitness for a particular purpose and non-infringement of third party rights.

We will aim to correct any errors or omissions as soon as possible after being notified of them.

We do not accept liability for loss or damage of any kind arising indirectly from the use of the Site

and our liability for any other loss arising from the use of the Site shall be limited to £100.

We do not limit or exclude our liability for:

(i) death or personal injury caused by our negligence;

(ii) our fraudulent misrepresentation; or

(iii) any other liability that may not be limited or excluded under English law.

Privacy Statement

If you are a user with general public and anonymous access the Site does not store or capture personal information, but merely logs the user’s Internet Protocol (IP) address that is automatically recognised by the web server. 
We do not use cookies for collecting user information. We will not collect any information about you except your IP address which is used to record the number of visitors to the Site.
Personal data (that is, information which could identify you) submitted to the Site will only be used to respond to your feedback. We will not pass it on to any third party without your consent.
This privacy statement only covers the Site at www.britishchineseheritagecentre.org.uk and does not cover links within the Site to other websites.

Applicable Law

These Terms of Use are governed by the law of England and Wales and you agree that any disputes between us, including any non-contractual disputes, arising from these Terms of Use or the Site, will be dealt with only by the courts of England and Wales.
